Court dismisses Malami’s bail fid from EFCC custody
Justice Babangida Hassan, who delivered the ruling on Thursday, December 18, 2025, held that Mr Malami was lawfully detained by the anti-graft agency based on a valid remand order.
Mr Malami, through his counsel, Dr Sulaiman Hassan (SAN), had urged the court to grant him bail, arguing that his continued detention by the EFCC in the course of an ongoing investigation was illegal.
However, counsel to the EFCC, Chief J.S. Okutepa (SAN), told the court that the former minister was being held pursuant to a valid remand order granted by another FCT High Court presided over by Justice S.C. Oriji. He added that the EFCC is a law-abiding agency that would not detain any suspect beyond the period allowed by law without a court order.
In his ruling, Justice Hassan, while citing Section 35 of the 1999 Constitution and relevant provisions of the Administration of Criminal Justice Act, ACJA, held that the remand order was lawful and binding.
